Terms & Conditions for Caregiver / Nanny / House Maid Inquiries
Please read the following Terms and Conditions carefully before making an inquiry or confirming a Caregiver, Nanny, or House Maid through the Company.
1. Availability Dates
The availability date displayed on the Company's website is based on the information provided to the Company by the respective Caregiver, Nanny, or House Maid.
The availability shown on the website should therefore be considered subject to confirmation and does not guarantee that the person will be available at the time of your inquiry.
2. Qualification Verification
If you require verification of the qualifications, certificates, experience, or other documents of a Caregiver, Nanny, or House Maid, please inform the Company.
After you confirm the duty or assignment, the Company will provide the relevant available documents or verification details, subject to the Company's policies and applicable privacy requirements.
3. Availability May Change
Although a person may be shown as available on the website, their availability may change due to various reasons, including another confirmed assignment, personal circumstances, travel difficulties, illness, family matters, or other unforeseen circumstances.
Therefore, the Company cannot guarantee that every person displayed as available will remain available until the duty is confirmed.
4. No Direct Deals with Caregivers, Nannies, or House Maids
Customers are strictly prohibited from making direct employment or financial arrangements with a Caregiver, Nanny, or House Maid introduced or provided by the Company without the Company's prior written approval.
This includes:
- Hiring the person directly without informing the Company.
- Making private payment arrangements.
- Taking the person away from the Company's service arrangement.
- Using the person for private services outside the agreed Company arrangement.
- Sharing or exchanging contact details for the purpose of bypassing the Company.
- Continuing a private employment relationship after the Company has introduced the person.
If a customer enters into an unauthorized direct arrangement with a person introduced by the Company, the Company reserves the right to take appropriate legal action where applicable.
In such circumstances, the Company may also discontinue its responsibility for future duties or services related to that direct arrangement.
5. Payment Procedure
All payments relating to the agreed service must be made directly to the Company.
The customer should not make salary, service payments, commissions, advances, or other agreed payments directly to the Caregiver, Nanny, or House Maid unless specifically authorized by the Company in writing.
The Company will make the applicable payment to the assigned person according to the agreed terms.
6. Agreement Before Commencement of Duty
Before the Caregiver, Nanny, or House Maid commences the agreed duty, the Company and the customer must sign the relevant service agreement.
The agreement will specify the applicable terms, responsibilities, payment arrangements, duration of the service, and other relevant conditions.
The assigned person may also be required to sign a separate agreement with the Company.
7. Reasonable Time for Placement
After the customer confirms a duty, the Company will require a reasonable period to arrange and provide a suitable Caregiver, Nanny, or House Maid.
The Company may need to arrange the person from another part of Sri Lanka. Therefore, transportation, travel arrangements, availability, and other practical matters may affect the commencement date.
Customers are requested to allow the Company sufficient time to complete the placement process.
8. Payment After Invoice
Once the Company issues an invoice to the customer, the customer must make the required payment to the Company's designated bank account within 24 hours, unless a different payment period has been agreed in writing.
The customer should retain the payment receipt or bank transfer confirmation and provide it to the Company when requested.
9. Replacement if the Selected Person Becomes Unavailable
If the selected Caregiver, Nanny, or House Maid becomes unavailable before commencing the duty due to illness, personal circumstances, another confirmed assignment, travel difficulties, or another reasonable cause, the Company will make reasonable efforts to propose another suitable person.
The replacement will be based on the customer's requirements and the availability of suitable candidates.
10. Final Decision and Company Authority
The Company reserves the right to make the final decision regarding the placement, selection, replacement, scheduling, and other operational matters relating to the service.
The Company will make reasonable efforts to provide a suitable person according to the customer's requirements. However, availability and circumstances may change, and the Company cannot guarantee the availability of a particular individual at all times.
All decisions and actions of the Company will be subject to the agreed service agreement and applicable laws and regulations.
11. Customer Responsibility
The customer is responsible for providing accurate information regarding the required duties, working location, working hours, accommodation arrangements, salary or service requirements, and any other relevant conditions.
The customer must not request the assigned person to perform duties that were not agreed upon without appropriate discussion and approval.
12. Acceptance of Terms
By making an inquiry, confirming a Caregiver, Nanny, or House Maid, making payment, or signing the service agreement, the customer confirms that they have read, understood, and agreed to these Terms and Conditions.
Caregiver / Nanny / House Maid Registration — Terms & Conditions
By registering with the Company as a caregiver and accepting a duty assigned by the Company, you agree to comply with the following Terms and Conditions.
1. Responsibility for Availability and Agreed Dates
The caregiver is responsible for the availability and dates provided to the Company. Once a caregiver confirms availability for a particular duty or period, they are expected to be available and report for duty as agreed.
If the caregiver is unable to attend the agreed duty for any reason, the caregiver must inform the Company as soon as possible.
2. Verification of Qualifications and Documents
The caregiver must provide accurate and genuine information regarding their qualifications, experience, training, and professional background.
If the Company requests documents to verify the caregiver's qualifications or experience, the caregiver must provide the relevant original documents or acceptable copies for verification.
Providing false, misleading, or forged documents may result in cancellation of registration and termination of any assigned duty, subject to applicable law.
3. Nature of Employment / Engagement
Caregivers registered with the Company are engaged on a contract basis and are not considered permanent employees of the Company unless a separate written employment agreement states otherwise.
The terms of each assignment, including the duty period, working arrangements, and agreed payment, will be communicated by the Company before the caregiver starts the assignment.
4. Contract Signing Before Commencement of Duty
Once a caregiver is selected for a duty, the caregiver must visit the Company's head office before commencing the assignment, unless the Company provides another approved arrangement.
The caregiver is required to read, understand, and sign the relevant contract or agreement before starting the duty.
5. Payment
The Company will pay the caregiver the agreed and confirmed payment for the completed duty in accordance with the applicable contract or assignment terms.
No additional payment, allowance, commission, or other amount will be payable unless it has been officially agreed and approved by the Company.
Payment may be subject to the caregiver fulfilling the agreed duty requirements and providing the required documents.
6. Prohibition of Direct Deals with Customers
Caregivers must not make private or direct financial or employment arrangements with customers introduced or assigned by the Company without prior written permission from the Company.
This includes, but is not limited to:
- Accepting direct employment from a Company customer without Company approval.
- Negotiating private payment arrangements with customers.
- Receiving additional payments or commissions directly from customers without authorization.
- Providing services to Company customers privately in a manner that bypasses the Company.
- Sharing or using customer information for personal business purposes.
Any unauthorized direct arrangement may be treated as a serious breach of the caregiver's agreement. The Company reserves the right to take appropriate action, including legal action where applicable.
Any payment-related dispute or outstanding amount will be handled in accordance with the contract and applicable law.
7. Required Documents
Before or at the commencement of a duty, the caregiver must provide the documents requested by the Company for registration, verification, payment, and record-keeping purposes.
These may include:
- A copy of the caregiver's valid National Identity Card (NIC) or other accepted identification.
- A copy of the caregiver's GS certificate or other relevant qualification certificate.
- A copy of the caregiver's bank passbook or official bank account details.
- Relevant training and experience certificates, where applicable.
- Any other documents reasonably requested by the Company.
The caregiver is responsible for ensuring that all submitted documents and information are genuine, accurate, and up to date.
8. Duty Cancellation or Leaving an Assignment
A caregiver must not leave, abandon, or discontinue an assigned duty without informing the Company.
If the caregiver needs to terminate or discontinue a duty due to an emergency or other valid reason, the caregiver must immediately inform the Company and follow the agreed procedure.
Failure to provide proper notice or abandoning a duty may be considered a breach of the agreement and may affect the caregiver's eligibility for future assignments and payment, subject to the terms of the contract and applicable law.
9. Professional Conduct and Company Goodwill
Caregivers are expected to maintain professional conduct at all times while representing or working through the Company.
The caregiver must:
- Treat customers, patients, family members, and other staff with respect.
- Maintain confidentiality regarding customer and patient information.
- Follow reasonable instructions related to the assigned duty.
- Maintain appropriate personal hygiene and professional appearance.
- Avoid behaviour that may damage the reputation or goodwill of the Company.
- Not engage in dishonest, abusive, threatening, or inappropriate conduct.
- Protect Company and customer property entrusted to them.
Any serious misconduct may result in cancellation of the assignment and further action in accordance with the contract and applicable law.
10. Company Authority and Final Decisions
The Company has the authority to make decisions regarding caregiver registration, selection, assignment, replacement, duty arrangements, and other operational matters.
The caregiver agrees to follow the Company's reasonable policies, procedures, and instructions relating to the assigned duty.
However, all decisions and actions of the Company will remain subject to the applicable contract and the laws and regulations of Sri Lanka.
11. Confidentiality
Caregivers must maintain strict confidentiality regarding all personal, medical, financial, family, and other private information obtained while performing their duties.
Such information must not be shared with any third party without proper authorization, except where disclosure is required by law.
12. Customer and Company Property
Caregivers must take reasonable care of all property, equipment, documents, keys, uniforms, or other items belonging to the Company or customer that are entrusted to them.
Any loss, damage, or misuse caused by negligence or intentional misconduct may be investigated by the Company and dealt with according to the applicable agreement and law.
13. Accuracy of Information
The caregiver confirms that all information provided during registration is true and accurate.
If any information is found to be false, misleading, or intentionally withheld, the Company may review the caregiver's registration and take appropriate action in accordance with the contract and applicable law.
14. Acceptance of Terms
By signing the caregiver registration form or accepting a duty assigned by the Company, the caregiver confirms that they have read, understood, and agreed to comply with these Terms and Conditions.
The caregiver also acknowledges that failure to comply with these Terms and Conditions may affect their future assignments and may result in action being taken in accordance with the relevant agreement and applicable law.
